Payments

Customers who are on recurring monthly plans are due for automatic billing from their credit card one month after their sign up date, and every month thereafter, on or about the same day of the month.

If your credit card information has changed, then you must notify us immediately so we may change this information. If on your bill date, your credit card is declined, or payment is not made, you will get a notice that your account will be suspended in 5 days. If after this notice and 5 days has passed, your account may be interrupted temporarily and an email will be sent to the address on file to notify you of this problem. If payment is not arranged within 14 days, we will close your account, and any files will be lost. All prices are in US Dollars (USD).

Any other payments, such as check or bank transfer must be received to be posted by the due date for your account.

Credit Card Payments

We are happy to accept Visa, MasterCard, American Express cards for payment. We use various fraud prevention methods to protect us, our merchant account, our bank and the customer who owns the credit card being used. This includes tracking the IP number and ISP of the person who is using the credit card, verifying the card matches the Zip Code and address of the cardholder. If anyone attempts to obtain service using a fraudulent or unauthorized credit card, your hosting account will be terminated without warning. We will have the right to place an 'account suspended' page on your IP or domain, and we will cooperate with authorities to report the incident and the information used to obtain the account including your domain name.

We will also bill you for all charges to us, including but not limited to bank fees, amounts charged back, plus 5%. We take credit card fraud very seriously. If you have received a credit card statement with our name on it, and did not order our services, please email us immediately at: abuse@pleth.com.

Collections and Account Suspension

Any account that is 30 days past due is subject to suspension of service. Upon restoring the account status to current, resumption of service fees may be applied. Any account that is 60 days past due is subject to collections by our third party collection agency, Dunn & Bradstreet Co., Inc.

Development Costs

All projects are proposed and accepted prior to internal tasking at Pleth. A 50% deposit of the proposed development cost is required to put a project onto our project calendar and the remaining balance is due prior to the launch of each project. In some cases, additional arrangements can be made, but must be made prior to the acceptance of a project proposal.

Maintenance and Updates

All web maintenance and updates are billed at an hourly rate of $60 per hour, with a minimum of 1 hour per incident. To reduce maintenance fees and update charges, we recommend sending all updates and maintenance to our development team in it's final, consolidated form with all grammatical and content edits intact.

Cancellation of Service

If for any reason you are not satisfied with our services, please let us know. We build our services around making hosting simple for the customer and want you to be satisfied.

We will discontinue billing your account at the end of your current bill cycle. No refunds are issued for hosting services already paid for, except during the first 30 days of service.

Excessive Resource Usage

Any web site that uses an excessively high amount of server resources including but not limited to CPU time, memory, and network bandwidth, will be given an option of either upgrading their service level or reducing the resource used to an acceptable level.

Spamming Not Permitted

You must not use any Pleth, LLC equipment or any Pleth, LLC hosted email address in connection with the transmission of spam, flames, mail bombs, or substantially similar, unsolicited email messages. Your domain may not be referenced as originator, intermediary, or reply to address in any of the above.

This shall include the sending of unsolicited mass mailings from any other service that in any way implicates the use of the Pleth, LLC equipment or any Pleth, LLC email address.

A message is considered to be unsolicited if it is posted in violation of a newsgroup charter or if it is sent to a recipient who has not requested or invited the message. Simply making one's email address accessible to the public will not constitute a request or invitation to receive messages, for purposes of enforcing this provision.

When any customer is found to have been engaged in spamming in violation of this agreement, Pleth, LLC reserves the right to disable that customer's web site without warning.

In addition, Pleth, LLC may impose a $200 penalty for each spam policy violation. Pleth, LLC solely reserves Pleth, LLC the right to refuse or cancel service to spammers. Pleth, LLC reserves the right to determine standards for violation of this policy. As such, any violation may result in cancellation of services without refund.

Refusal of Service

Pleth, LLC reserves the right at its sole discretion to refuse or cancel service. Violation of any of Pleth's Rules and Regulations could result in a warning, suspension, or possible account termination. Accounts terminated due to policy violations will not be refunded including during the 30 day money back guarantee period.

This policy pertains to the design, concept, and development of client projects. This policy is subject to future revisions by Pleth, LLC.

  • Prior to the start of any project, a 50% retainer is required to secure a start date on our development calendar. If for any reason a client does not have the required materials needed to complete a project by the anticipated start date, the project may be moved to a later date on the development calendar.
  • All concepts will be placed online for client approval.
  • Phase one of the development process is overall appearance. This includes colors, fonts, graphics, and also site outline or navigation. Only when the site shell has been approved, do we proceed to phase two. This focus insures that the project meets deadlines and also prevents any misunderstandings as the site develops. During this time, our team may make recommendations concerning layout, design, and concept based on our years of experience building quality websites, but our overall goal is client satisfaction.
  • Phase Two of the development process is content development. The client is responsible for all site content and photography unless prior arrangements have been made. Upon request Pleth can arrange for copyrighters, proofreaders, and photographers. These services are provided by highly skilled professionals at an additional charges.
  • Phase Three is site testing. This allows the client to again preview the site at one of our test domains to demonstrate how the site is going to flow and perform once live. During this phase, routine edits to content and graphics can still be initiated, but will only act to slow down the development process.
  • Once Phase Three is online and the client signs off on the completion of the project, the remaining account balance is due. Upon payment, the site is ready to be launched at the permanent domain address.

At no time will Pleth, LLC or it's partners and assigns ever discuss or exchange sensitive data with outside parties. This includes project notes, product announcements, or any other potentially harmful information that could damage a client's performance financially.

The only time we will discuss your project with an outside party is in the case a third party provider is brought in and at which time, Pleth will notify the client that a third party provider or strategic partner has been brought in. Non-disclosure agreements are also available on the front-end of all projects upon request, otherwise this statement serves as formal notice of our position.

Such cancellation of services for cause, specifically the reasons provided herein, shall automatically void Pleth, LLC's 30 day Money Back guarantee.

Collection, Use and Transfer of Your Information

You can visit most of the Pleth site without disclosing your personally-identifiable information. However, you may choose to provide us with your personal data, for example when you contact us, request a proposal, or open a technical support ticket. You also may decide to provide us voluntarily with personal data of a third person, such as your spouse, colleague or business partner. In such case, we assume that you have an unrestricted permission of such person to provide her personal data to Pleth. Pleth may use suppliers to collect, process, store, use, analyze and/or transfer the data on its behalf. In such case, it is Pleth's practice to require that these suppliers handle the personal data they process or transfer in a manner consistent with Pleth Networks policies. By submitting the personal data to us, you acknowledge and agree with your data being processed and/or transferred on Pleth's behalf by its suppliers.

If you visit our site to read or download information, such as news, product information, case studies or software

We may collect, process or transfer only the following information about you: the name of the domain from which you access the Internet; the date and time you access our site; and the Internet address of the website from which you linked directly to our site. We use the information we collect to measure the number of visitors to the different sections of our site, and to help us make our site more useful to visitors. We may use cookies and/or technologies to collect personally non-identifiable information from your visits to our website to enhance your overall site experience and for statistical purposes. You can set your browser to turn off ?cookies? or to warn you when a website attempts to place a "cookie" on your computer. However, if you turn off the cookies, some websites may not work properly.

If you submit personal data when visiting a Pleth website

We may collect, process and/or transfer the specific information you voluntarily provide to us in the contact form you choose to fill in on our website, including the personal data you provide. By submitting any personal data on Pleth Networks site, you authorize Pleth to use, process and transfer (if necessary across borders) such data, even in and to countries where the level of data protection may not be commensurate with the high standard of protection adopted by certain countries, such as the standard suggested by the EU Data Protection Directive. In such countries, Pleth will still handle your personal data in the manner described in this Privacy Policy. Pleth will not sell personal data to third parties; however your personal data may be automatically transferred to the successor to substantially all of the assets and business of Pleth.

If you are a client, or are part of a client organization, or are a subcontractor

Personal data you provide to Pleth, including personal data of a third party, such as your spouse, colleague and friend may be collected, stored, used and transferred as necessary for Pleth to carry out business or seek potential business in the future with your company. If you provide us with personal data, whether in the form of an e-mail, business card, orally during business meeting or otherwise, we assume that you have granted us a permission to collect, store, use and transfer such information with no limitations even in and to countries where the level of data protection may not be commensurate with the high standard of protection adopted by certain countries, such as the standard suggested by the EU Data Protection Directive. We also assume that you have unrestricted permission from the third party for the transfer of its personal data.

Disclosure Required by Law

Please be aware that it is possible that personal data you provide to Pleth may be subject to disclosure under the law (e.g. pursuant to a statutory provision, a court order or a subpoena).

Sensitive personal information

Pleth will not generally collect, process or transfer sensitive personal data through its site, unless you expressly consent with such collection, processing or transfer. ?Sensitive personal data? for the purposes of this Pleth Privacy Policy shall mean data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, and data concerning health or sex. By providing us with unsolicited sensitive personal data, you explicitly consent to such data being collected, processed and transferred by Pleth.

Correction, Update and Deletion of the personal data

Pleth will provide you with a possibility to ensure that the personal data you provided to us is accurate and up to date. You can request correction, update and deletion of your personal information via e-mail sent to corporate@pleth.com, and we will use reasonable efforts to contact you regarding your request.

In case you chose to be on a mailing list for periodic email updates regarding Pleth services and events, you also can use this e-mail address corporate@pleth.com to send us a notification that you no longer want to receive such information. We will honor your choice and refrain from sending you such announcements. You may change your choice at any time.

To update or delete your data or correct an inaccuracy, we may ask you to verify your identity and cooperate with us in our effort.

Security of Your Personal Information

Pleth uses various organizational and technical measures to protect your privacy and avoid unauthorized use or disclosure of your personal data. However, you should note that no transfer of data over the Internet is completely secure. While we use reasonable efforts to protect your data on our systems, when the data is transferred over the Internet, it may be accessed and used by unauthorized third parties. Pleth has no control over the performance, reliability, availability or security of Internet and does not warrant that any information transfer via Internet or any communication through Internet is secure. Pleth shall not be liable for any disclosure, unauthorized use, loss, damage, expense, harm or inconvenience resulting from the loss, delay, interception, corruption, intervention, misuse or alteration of any personal information due to any reason beyond Pleth Networks reasonable control.
